Can You Sell Delta-8 in a Smoke Shop? The Layer Where Every Table Disagrees

Ask three websites whether delta-8 is legal in Florida, Maryland, Michigan or Minnesota and you will get three different answers — the aggregator tables contradict each other state by state. That fog is the honest starting point: for most states there is no trustworthy compiled answer, which is why this site marks unverified hemp rows as not yet verified instead of guessing. Here is what is solid, from dated enactments.

Banned or dispensary-only (verified)

Regulated or open (verified)

Minnesota licenses lower-potency hemp products — registration, per-serving caps, testing, 21+. Oklahoma remains permissive, confirmed by its agriculture department's January 2026 clarification letter. Between the bans and the open states sits a middle group with licensing bills moving — the fastest-rotting layer in this entire field.

The federal date that hangs over all of it

A federal change to the definition of hemp takes effect December 11, 2026 — measuring total THC (including THC-A) against the 0.3% line, with converted/synthetic cannabinoids losing hemp status even earlier, on November 12, 2026 (as reported across industry sources, fall 2026). If hemp is any part of your opening plan, that date matters more than your state's current rule — and any hemp inventory you hold needs a sell-through plan against it.

This page is information, not legal advice. Hemp rules are the layer we re-verify most often; the date at the top of your state page is the date its hemp row was checked.
