State license required Flavor ban Hemp (delta-8 / THC-A): banned at smoke shops
How to open a smoke shop in California starts with the state stack below — then the product rules, which decide what your shelves may hold — then your city, which decides your address. Run the same facts through the free checker with your exact product mix for a verdict.
| Item | What it is |
|---|---|
| Business registration + sales tax permit | Register the business and get the seller's permit first — the tobacco application asks for it. |
| Cigarette and Tobacco Products Retailer's License | Issued by: California Department of Tax and Fee Administration (CDTFA). Fee: $450 per location, per year. Raised from $265 on July 1, 2026 (CDTFA Special Notice L-1021; Bus. & Prof. Code §22973.3). CDTFA may raise it to $600 by regulation. Renewal: Every year — and California does not prorate: the full fee is due whenever you apply. |
| Local business license | Plus any local tobacco permit your city runs, and fire/occupancy sign-off where required. There is no federal retail license for a smoke shop. |
Banned: Flavored tobacco products, including flavored vapes — and since January 1, 2026, ALL disposable vapes, flavored or not — in force since Dec 21, 2022 (SB 793); disposable ban Jan 1, 2026 (AB 762). California also has 156+ local flavored-tobacco rules (Truth Initiative, Q3 2025) — your city can be stricter than the state.
California treats intoxicating hemp products as cannabis: they belong in licensed cannabis dispensaries, not smoke shops. From January 1, 2026 (AB 8), a tobacco retailer may not possess or sell cannabis products on the premises at all — products can be seized.
Many California cities require a conditional use permit for smoke shops, with distance rules (600 ft from schools, parks, churches and other smoke shops is a common pattern — Selma's ordinance is the worked example in our city sheets).
