State license required Vape directory state Flavor ban Hemp (delta-8 / THC-A): not yet verified
How to open a smoke shop in Utah starts with the state stack below — then the product rules, which decide what your shelves may hold — then your city, which decides your address. Run the same facts through the free checker with your exact product mix for a verdict.
| Item | What it is |
|---|---|
| Business registration + sales tax permit | Register the business and get the seller's permit first — the tobacco application asks for it. |
| State tobacco retailer permit (general or specialty business) | Issued by: Utah State Tax Commission. Fee: not in our verified sources — most states charge $15–$500 per location (industry guides, 2025–2026). |
| Local business license | Plus any local tobacco permit your city runs, and fire/occupancy sign-off where required. There is no federal retail license for a smoke shop. |
Vapor product directory (enacted — challenged in court).
Utah enacted a vapor product directory, but its rollout has been challenged in court. Treat the Attorney General's current list as the one that counts when you order.
Banned: Flavored e-cigarettes — in force since January 1, 2025. Utah bans flavored e-cigarettes statewide (a court fight over parts of the law continues — the ban is the rule to plan around).
Not yet verified. We have not yet primary-verified Utah's rules for hemp-derived products, and the public tables openly contradict each other on states in this position. Do not plan a hemp shelf on a guess: ask the state agriculture or health department, in writing, before hemp enters your opening order.
Utah writes its distance rules at state level: a tobacco specialty business must sit 1,000 ft from schools, churches, parks and childcare, and 600 ft from another tobacco specialty business (Utah Code §10-8-41.6). Salt Lake City adds a county health permit + city license.
Not your city? The address rules are still local — run the six-step worksheet in our distance-rules guide before you sign.
Most state tobacco licenses run $15–$500 per location (industry guides, 2025–2026); your state page fee line says plainly when we have not verified the exact figure. The full stack — state, local, permits — is the table above.
No — Flavored e-cigarettes (since January 1, 2025).
We cannot honestly tell you yet. Utah's hemp-derived rules are marked not-yet-verified on this page because the public sources contradict each other. Ask the state agriculture or health department in writing before planning a hemp shelf.
